2. Description of Service
CleanGeek is a multi-tenant software-as-a-service (SaaS) platform designed for cleaning service companies, including but not limited to carpet cleaning, janitorial services, maid services, pressure washing, window cleaning, and post-construction cleanup businesses.
The Service provides:
Booking and scheduling management for cleaning appointments
Technician dispatch and GPS tracking for field workers
Customer relationship management (CRM) with customer portals
Invoicing and payment processing via Stripe integration
Communication tools including email, SMS, and in-app messaging
Reporting and analytics for business performance

CleanGeek does not itself provide cleaning services. We provide software tools to cleaning service companies ("Operators") who use the platform to manage their own businesses.
3. Account Registration and Responsibilities
3.1 Registration
To use the Service, you must register for an account by providing accurate, current, and complete information. Each company account constitutes a separate tenant on the platform. You may register as a company owner and subsequently invite additional users with defined roles (admin, dispatcher, technician).
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to:
Use a strong, unique password for your account
Not share your login credentials with unauthorized individuals
Immediately notify CleanGeek of any unauthorized use of your account
Ensure that all users within your company account comply with these Terms
3.3 Account Roles
Company accounts support the following roles, each with varying levels of access:
Owner: Full access to all features, billing, and company settings
Admin: Manage staff, customers, and scheduling
Dispatcher: Scheduling, dispatch, and limited settings access

Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. All fees are quoted in United States Dollars (USD) unless otherwise stated.
4.3 Cancellation and Refunds
You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation, your account will remain active until the end of the current billing period, after which it will revert to the Basic plan. We do not provide prorated refunds for partial billing periods.
4.4 Price Changes
We reserve the right to modify subscription pricing with at least 30 days' written notice. Price changes will take effect at the start of the next billing cycle following the notice period.
5. Platform Fees
In addition to subscription fees, CleanGeek charges a platform fee on transactions processed through the Service. Platform fees are calculated as a percentage of each transaction and vary by plan:
Trial: 3% per transaction
Basic: 5% per transaction
Professional: 3% per transaction
Enterprise: 2% per transaction
Platform fees are in addition to any payment processing fees charged by Stripe. Fee percentages are configurable and may be adjusted with prior notice. Current fee rates are always available in your account settings.
6. User Content and Data Ownership
6.1 Your Data
You retain all ownership rights to the data you input into the Service, including customer records, booking information, financial data, photos, and any other content you create or upload ("Your Data"). CleanGeek does not claim ownership of Your Data.
6.2 License Grant
By using the Service, you grant CleanGeek a limited, non-exclusive, worldwide license to host, store, process, and display Your Data solely for the purpose of providing and improving the Service. This license terminates when you delete Your Data or close your account.
6.3 Data Export
You may export Your Data at any time through the reporting features of the Service (CSV/PDF export). Upon account termination, we will make Your Data available for export for a period of 30 days.
6.4 Uploaded Content
Content you upload (including company logos, service photos, before/after images, and damage documentation) must not violate any applicable laws, infringe on third-party rights, or contain malicious code. We reserve the right to remove any content that violates these Terms.

Informing your technicians that location tracking is active during work hours

CleanGeek bears no responsibility for labor law compliance, worker classification, wages, or benefits.
9. Customer Data Handling
9.1 Multi-Tenant Data Isolation
CleanGeek operates as a multi-tenant platform. All data is logically separated by company. No Operator can access data belonging to another Operator's account. Each data query is scoped by company identifier to ensure strict tenant isolation.
9.2 Operator Responsibilities
As an Operator, you act as the data controller for your customers' personal information. You are responsible for:
Obtaining appropriate consent from your customers to store and process their data on the platform
Maintaining your own privacy policy that discloses the use of CleanGeek as a data processor
Responding to data access, correction, and deletion requests from your customers
Complying with all applicable data protection laws and regulations
9.3 Customer Portal

10. Intellectual Property
The Service, including its software, design, logos, documentation, and all related intellectual property, is owned by CleanGeek and protected by copyright, trademark, and other intellectual property laws.
Enterprise plan subscribers who use white-label branding features are granted a limited license to replace CleanGeek branding with their own within the Service interface. This license does not transfer any ownership of the underlying software or technology.
You may not use the CleanGeek name, logo, or trademarks without our prior written consent, except as expressly permitted for linking to or referencing the Service.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLEANGEEK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
CLEANGEEK'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO CLEANGEEK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100).
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CLEANGEEK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
12. Indemnification
You agree to indemnify, defend, and hold harmless CleanGeek, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

13.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately (or at the end of the billing period for voluntary cancellations). We will retain Your Data for 30 days following termination to allow for export, after which it may be permanently deleted. Provisions that by their nature should survive termination (including Sections 6, 10, 11, 12, and 15) will survive.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice within the Service at least 15 days before the changes take effect.
Your continued use of the Service after the effective date of any modifications constitutes acceptance of the updated Terms. If you disagree with any changes, you must stop using the Service and terminate your account.
Non-material changes (such as typographical corrections or clarifications that do not alter the meaning of the Terms) may be made without advance notice.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
